Sounds like Gonzaga tried in good faith to book a date. Unfortunately according to a poster on the Zags message board http://forums.espn.go.com/espn/thread?f ... D=11924749 The Holiday Tourney is in the middle of the contracted date range and they tried to move their Washington game.
I don't know why we wouldn't. Great idea. Why try to find a mutually acceptable alternate date or push the series back for a year when you can sue. Sounds good to me.

• The Gonzaga-Massachusetts scheduling fiasco could end up in litigation.
Gonzaga owed UMass a return game after the Minutemen played in Seattle last season. Gonzaga's Jerry Krause (the director of basketball operations, not the Bulls former GM), said he agreed with the former UMass coaching staff (Steve Lappas) to play the game sometime between Dec. 28 and Jan. 4.
Well, when Travis Ford took over, he authorized games in the Holiday Festival in New York and a home game at Boston College.
UMass offered up Nov. 30 as an alternative. Krause said he originally agreed, signing an addendum to the contract. But he said as soon as he sent the contract, he called UMass to say the 30th wouldn't work because the Bulldogs couldn't convince Washington to switch the date of their game in Seattle.
But UMass wants to play on Nov. 30 or expects to receive a $100,000 buyout, per the contract terms, so this looks like it is heading to litigation.
Ford said the matter is in the hands of the athletic directors. He said both ADs signed the deal.
"We're playing on that date or there will be a buyout," Ford said.
In the interim, Gonzaga is looking at backups, talking to Wisconsin, Boston College and Ohio.
Scheduling is becoming even tougher, especially when coaches take over new jobs. The NABC ethics commission addressed this at their meeting two weeks ago. Still, BC is dealing with Stony Brook not honoring a contract to come to the Heights, according to the BC staff. Ohio is also haggling with Western Carolina, which won't honor a contract to play in Athens.
